Terms of Service

These Terms of Service ("Terms") govern your use of ABA Prep (the "Service"), operated by Rainbows Behavior Corp ("Rainbows Behavior Corp", "we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

ABA Prep is an online study tool for the Registered Behavior Technician (RBT) exam, including flashcards, practice quizzes, study guides, and a simulated exam, offered in English and Spanish. The Service is not affiliated with or endorsed by the Behavior Analyst Certification Board (BACB).

2. Eligibility & Accounts

You must be of legal age in your jurisdiction to enter into a binding contract. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

3. Acceptable Use

You agree not to misuse the Service, including by:

  • using the Service for any unlawful purpose, fraud, or spam;
  • infringing the intellectual property or other rights of any party;
  • interfering with security, probing, scanning, scraping, or transmitting malware;
  • reverse engineering, reselling, or redistributing the Service;
  • circumventing technical limits or any rate limiting.

4. Intellectual Property

Rainbows Behavior Corp and its licensors retain all right, title, and interest in and to the Service, including software, content, study materials, branding, and documentation. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service within your selected plan for your personal study.

5. Subscriptions, Billing & Payments

Paid subscriptions ("Pro Monthly" at $19.99/month or "Pro Yearly" at $149/year) renew automatically at the end of each billing period until canceled. You may cancel at any time and keep access until the end of the current period. Upgrades and downgrades take effect immediately and are prorated.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms at paddle.com/legal/checkout-buyer-terms, in addition to our Refund Policy.

6. User Content

You retain ownership of any content you submit. You grant us a limited license to host and process that content solely to operate the Service.

7. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may stop using the Service and close your account at any time.

8. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee uninterrupted or error-free operation and we do not guarantee any particular exam outcome.

9. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify Rainbows Behavior Corp from claims arising out of your content, your unlawful use of the Service, or your violation of these Terms.

11. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email; continued use after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Rainbows Behavior Corp is established, without regard to conflict of law rules.
